Center Libertarianism: Liberty, Property, Democracy, Method

Keep the person as the unit of title and voice; stop treating the scaled firm and the representative office as private legislatures; change species at scale rather than abolish personal property; exit by building the alternative rather than seizing the existing coercive monopoly.

Why it is called Center. Left libertarianism (Déjacque 1857: anti-authoritarian; property as dominion) and right libertarianism (Russell 1955, Nozick 1974: the person as unit of title) both claim liberty. They split on property. This stack is an attempt to reconcile them on historically accurate terms — not a Nolan-chart midpoint, not a rebrand of the US party, not a Proudhon restatement that forgot the right existed. The left file is Fractures. The right file is Foundations of the Right. The map is where this stack sits: the wide bottom of our shoe — this program’s invention — opposite mixed-economy “center” at the wide top of Faye’s, not a Nolan midpoint. This paper is the join.

Motivation, from [Agency](/agency): maximize institutional agency — the room a structure leaves for persons as sources of their own transitions — in government and in the economy. That is not a proof of free will. It is the design constraint. Authoritarian command, absentee title, and representative filters all shrink the unit. CenLib is a bid to enlarge it.

This is a scientific proposal, not a manifesto. It articulates a problem (the person is treated as an ensemble by both absentee title and the party-state), offers a model (the property triad, nested assemblies, a named method of transition), and leaves the joints that do not close as open problems. It does not advocate violent means to a revolutionary end. The author holds that the stack becomes useful under post-scarcity conditions — in the sense Marx used modes of production: an account of what a later material situation will need. No crystal ball. The method is not foolproof. That is where past attempts decomposed.

Constraints of this corpus: no listed stocks and bonds; B-corp-like standing pushed past residual liquid title; allotted agenda layer required and still unspecified.

Read Fractures first for the left-hand words, the 1872 split, and the named hybrid. Read Foundations of the Right for Lockean logic, capitalism as theory and as practice, the American inversion of “libertarian,” and the economic ideas of the right. Read Competition & Mutual Aid so Spencer and Kropotkin are not smuggled in as proofs, Equilibria so productive commons is named as a CPR problem and as a stag hunt rather than as a slogan, and Game of Empires so stepping off is not mistaken for leaving the board. The join is also an ecological join: neither Huxley’s gladiatorial show nor Kropotkin’s mutual aid as the only law. Two apples, or an orchard. Biology has not closed which picture is nature, so this stack will not wear either costume as proof.

1. Etymology that matters

• Liberty (early modern legal-political). Locke, Second Treatise §22: freedom under standing law versus arbitrary will; not “do as one lists.” Blackstone, Commentaries I.1: natural versus civil liberty.
• Libertarian (1789). Belsham’s label for the anti-necessitarian — a claim about agency, not about markets. Paper 01.
• Libertarian (19th-c. European left). Déjacque 1857–58; anarchists / anti-authoritarian socialists. Fractures.
• Libertarian (US, mid–late 20th c.). Private property in the means of production and a small state; Dean Russell’s 1955 trademark; Rothbard, Nozick, LP 1971. Full file: Foundations of the Right.

Center libertarianism is an attempt to rejoin the 1789 agency sense with a property split that neither US right-libertarianism nor applied Marxism kept. The right preserves Lockean title through the scaled firm and shareholder primacy, and so reconstitutes oligarchy. The left could not address private property without abandoning it, or addressed it by an office that did not retire. The attempted reconciliation is the triad below.

The name is the claim, not a mood. “Center” does not mean moderate, third-way, or a point on a Nolan chart. It means: hold both dated libertarianisms at the joint they actually fight over — property at scale — and refuse the two reconstitutions of oligarchy (the ticker, the office). The map draws that claim as an hourglass: mixed-economy center is the wide top of Faye’s shoe; this stack is the wide bottom of our shoe. Neighbors on that shoe are the two anarchist traditions, not fascism and the party-state. Hayek’s knowledge problem, Nozick’s Chamberlain challenge, and Cohen’s split of self-ownership from world-ownership are tools taken from the right-hand academy and used against title-through-the-firm. Agorism is taken from the Libertarian Left as method — left free markets, not a Rothbard fork. Bakunin is taken as firm structuring. That mix is the join. It is unfinished. The boards on this page are the schematic. The right-hand paper is the file.

2. Property axiom

Axiom: separate private property from the means of production while preserving private property for the person.

Three definitions:

1. Consumptive private — dwelling and land of occupancy / subsistence.
2. Personal — movable effects.
3. Productive — means of production. Solo / no employees: ordinary private title. When demand requires hired labor, legal species changes: employees become partial owners (one-share one-vote, holacracy, contribution-vested land trusts).

Thread constraint: no listed stocks and bonds as the vehicle of productive title. Those instruments are absentee sovereignty. Standing closer to a B-corp stakeholder table, pushed past Delaware law: occupant-operators hold use-shares; patrons and lenders hold time-capped non-control claims.

This is closer to Proudhon’s possession versus property than to Marx-after-1848 abolition or to Rothbardian homesteading of plants that hire hundreds. It is not a stock-market reform. There is no secondary market in control.

Locke’s joints, spent here. Foundations of the Right reconstructs the furniture: mixing (§27), the proviso (“enough, and as good”), spoilage (§31), money as tacit consent to unequal possession (§36–37), bequest as a later legal operation. Rothbard drops the proviso. Nozick keeps a weakened form and treats Chamberlain as a proof that patterned justice must continually interfere. Cohen (1995) splits self-ownership from world-ownership. The triad is a third option: self-ownership kept as an agency claim (the person is not an organ); world-ownership through the scaled firm refused; species-change at hired-labor scale as the restoration of the proviso where it actually bites. Chamberlain is answered as a change of legal kind at a threshold, not as a nightly redistribution of just holdings. Bequest of a plant that commands living occupants is not the mixer’s continued agency. Open problem 33.

Known gaps, named so they cannot be papered over:

• Who measures the threshold (employees? hours? site-dependence?) without a ministry. Gosplan and a Lochner court are both failures of this spec.
• How capital enters without voting control or a secondary market that recreates dominion. The negative rule (no listed stocks/bonds) is not yet a positive instrument.
• Land and platforms as productive property, not only factories and farms. Urban land, spectrum, rails, models.
• Subcontracting / “independent contractor” games around the threshold.
• Automation without hiring: if a firm can replace labor with models and robots, shareholder primacy is a reason not to hire. Species-change at hired-labor scale does not, by itself, answer a world where hiring is optional. That is an open problem, not a solved one — and it is where Harari’s replacement paradigm (below) lands on this paper.

3. Productive commons is a CPR problem

Hardin (1968) treated the commons as a prisoner’s dilemma that only private title or the state can solve. That is a parable of open access, not a description of a plant with named occupants.

Ostrom, Governing the Commons (1990): common-pool resources are subtractable and hard to exclude, but successful cases are not “open to all.” Users craft rules. The eight design principles (restated Cox, Arnold, and Villamayor-Tomás 2010) are the field literature this paper is allowed to lean on:

1. Clearly defined boundaries (who is a user; what is the resource). Occupant use-shares are an attempt at this. Absentee listed title is a way of being a “user” who does not monitor — a violation of 1 and 4.
2. Congruence of rules with local conditions.
3. Collective-choice arrangements: affected users can modify rules.
4. Monitoring, by users or accountable to them.
5. Graduated sanctions.
6. Accessible, low-cost conflict resolution.
7. Minimal recognition of the right to organize by external authorities. This is the hinge to [Game of Empires](/empires). A pole that does not recognize the right can wreck a working commons from outside.
8. Nested enterprises for larger systems. This is the hinge to nested assemblies. Local commons at the base, federated coordination above — not a single Gosplan, not a single ticker.

Olson, The Logic of Collective Action (1965): in a latent group, rational members free-ride. All-citizen senates, civic time, and “who monitors the threshold” are free-rider problems. Selective incentives can be benign (Ostrom’s graduated sanctions, allotted paid service) or extractive (the party that owns the revolution; the firm that owns the residual). Method is not free of this. Seizing the office solves free-riding by coercion. Agorist exit has the opposite problem: who contributes to the counter-institution when defection is cheap.

Halpern and Rong’s perfect cooperative equilibrium (Equilibria) shows that (C,C) can be an equilibrium concept in the underlying PD without being a best response. It does not write the monitoring rule. Naming Ostrom does not finish open problems 8, 9, 12, 13, 20. It names the literature that already refused Hardin’s dichotomy.

4. Polity axiom

Athens is the first experiment, not the template of success.

Standard facts (Hansen, The Athenian Democracy in the Age of Demosthenes, 1991):

• Cleisthenes, 508/7 BCE, demokratia.
• Ekklesia (assembly), Boule of 500 (agenda and daily administration, fifty per tribe, typically allotted from volunteers), Dikasteria.
• 404 BCE Thirty Tyrants; Thrasybulus restoration; Macedonian end of the classical experiment 322 BCE.
• Sortition was real; notable families still dominated rhetoric, liturgy, and the volunteer pool. The boule is already a filter. The Pnyx did not hold the whole citizen body.

The proposal:

• Local assemblies = all citizens of the region (the boule replaced by the people of the place).
• Federal “senate” = ekklesia of all citizens; no executive, no representative Congress.
• Modern ledgers / communications to solve room-size.
• Seriousness filters and pay for civic time so “everyone is a politician” is not only the leisured.

Elite-theory constraint. Mosca (organized minority), Pareto (circulation of elites), Michels 1911 (iron law of oligarchy inside socialist parties). Direct feeds without allotted agenda juries become either ochlocracy (Polybius) or staff-capture. Sortition belongs in the agenda layer, not only as nostalgia.

The lineage, so three names are not the file. Elite theory is the record of how popular forms decay into organized minorities. Plato’s ship and philosopher-king (Republic): the anti-demos as theory, not a mood. Aristotle’s politeia versus democracy as the poor ruling in their interest. Polybius’s anacyclosis (Histories VI): kingship → tyranny → aristocracy → oligarchy → democracy → ochlocracy → a new monarch; mixed constitution as attempted brake — taken here as a warning, not as a clock as tight as a law of nature. Machiavelli, Discourses (1531): two humors, the great who wish to dominate and the people who wish not to be dominated. Madison, Federalist 10 (1787): property as the most durable source of faction; a large republic as a filter — more democratic than monarchy, still an aristocracy of representation. Mosca 1896; Pareto 1901/1916 (elites circulate; they do not disappear); Michels 1911 (inside the party that claims to speak for you). Burnham, The Managerial Revolution (1941); Mills, The Power Elite (1956). Gilens and Page (2014): once economic elites and organized business are controlled, average citizens’ preferences do not predict US policy. A franchise on paper; an organized minority in the result.

How thwarting actually works — not one trick. Agenda oligarchy (staff, recommenders, the boule as filter; Manin 1997: the moderns chose election over lot and so chose aristocracy with a franchise). Property as faction, spent as a ticker (Madison named the source; limited liability made it liquid). The office that will not retire (applied Marxism-Leninism as the test of method). The pole that refuses Ostrom 7 (Game of Empires as the outer lock). Replacement tech under shareholder primacy (open problem 20). Inner conflict is how this happens without a knockout.

Anacyclosis remains the mixed-constitution problem. Center libertarianism must say which mixed elements it keeps (allotted few + voting many + narrow bound executive for time-critical acts) or it will replay the cycle it names. The “few” and the “one” are unspecified. That is Open Problem 15.

US founding was more democratic than monarchy and still an aristocracy via electoral college and representation. “We have never implemented a true democratic government” is the claim; the boule evidence is the reason Athens does not refute it.

The democracy that has yet to be tried sits in plain sight. The pieces have been on the table: sortition (Athens, Venice, Florence, juries now); occupancy-and-use (Proudhon 1840; Tucker); nested federation (Proudhon 1863; Bakunin; Ostrom 8); user-governed commons (Ostrom 1990); counter-economy as method (Konkin 1980). Elite theory is the record of how each piece, alone, was captured. The untried move is to assemble them without seizing the office: lot in the agenda layer; occupancy for consumptive and personal title; species-change at hired-labor scale; nested federation; CPR rules at the plant; agorist withering rather than a night. That is this stack, unfinished on purpose. Not nostalgia for the Pnyx. Not a coup. The board on this page is the schematic.

5. Method of transition: a named hybrid

The widget on this page is the short board. The text is the argument. CenLib’s method is not a church and not a coup. It is a hybrid, pulled from named sources, with the refusals stated so they can be attacked. Fractures is the left history; Foundations of the Right is the right history; this section is what the stack actually takes.

Agorism for withering. Konkin, New Libertarian Manifesto (1980); Movement of the Libertarian Left. Left free markets, not a Rothbard fork. Counter-economics; consistency of ends and means; no party road. Capital-statism is the enemy. You do not seize the existing coercive monopoly and hope the office retires. You practice occupant-operator production, local assemblies, and counter-institutions until the absentee form is unused. Engels’s bronze axe (Origin of the Family, 1884) is the criterion: the public power beside society is to become a museum piece. Agorism is the method that does not put a new hand on the axe-handle first. This program takes Konkin’s method from the left-market file, not Rothbard’s end-state in joint-stock, and not a romanticization of black markets as such.

Bakunin for firm structuring. Collectivism from below, 1868–73: land and instruments socialized inside federated workers’ units; no new ruling caste; the International as a federation of sections, not a General Council-state (Statism and Anarchy, 1873; Saint-Imier 1872). At hired-labor scale, CenLib’s species-change is that structure: occupant use-shares, nested, monitored by users (Ostrom 4). Refused: Bakunin’s secret brotherhoods, and insurrection as the method of getting there. Firm structuring is not a night.

Proudhon for possession. Occupancy-and-use; slow fire, not a St Bartholomew of proprietors (letter to Marx, 17 May 1846); federalism of communes (Du principe fédératif, 1863). Consumptive and personal title sit here. A market in control does not.

Marx and Engels for the mode, not the office. Historical materialism as a scientific claim about modes of production: offer what a later material situation will need. The author believes the stack becomes usable as scarcity recedes — automation, energy abundance, the cheapening of coordination — not as a putsch into a scarcity economy. That is “like Marx” in method of thought, not in the 1917 office. The Marxist political method is a series of steps Fractures dates and the map keeps as a section, not a filter: leave mixed; socialize the means of production; hold a dictatorship of the proletariat as a stepping stone to common ownership. In practice that office became the party-state. This stack refuses those steps as a road. Simultaneity of the leading countries (Principles of Communism, 1847; Manifesto) remains a constraint: without something like broad or extra-hegemonic transition, Game of Empires and elite theory topple a domestic stack. The economic form of the unplug is now dated: SWIFT cuts, entity lists, frozen reserves (~$300bn of Bank of Russia assets, 2022), and — the 2025 demonstration — a rising pole’s processing chokepoint (rare earths) that is not a reserve currency and can still halt an industry. Dalio’s reserve-currency lag is the math for why the dollar unplug still works after military peak. Extra-hegemonic standing-up of a stack (a frontier) is one attempted answer. Simultaneous transition is the other. Either drop the constraint or make it a designed phase. Do not leave it as a hope. Open Problem 14.

Ostrom for the plant as a CPR. Already §3. Naming it does not finish the specs.

Still for the academy — a new declaration and constitution. Among people already living the rule, not a vanguard draft. Threshold, investment without dominion, allotted agenda, pay without vote-buying, the few and the one of a mixed constitution: open problems 8, 9, 10, 11, 15. This is the stage at which every past attempt decomposed through infighting and an inability to agree (Fractures §6). A scientific program leaves those joints visible. It does not paper them with a fake constitution, and it does not treat disagreement as treason.

Not a revolutionary war if it can be avoided; not a party that owns the threshold rule; not violent means to a revolutionary end.

6. What this stack takes from the right — and what it refuses

The join board on this page is the schematic. Foundations of the Right is the file. Compressed, so it can be attacked:

Taken. The person as unit (Locke Essay II.xxi; Second Treatise §22, §27, §123). Self-ownership as an agency claim: the person is not an organ of class, ticker, or party. Standing law versus arbitrary will — Pettit’s non-domination is a later name for Locke’s test. Hayek 1945 and Mises 1920 / 1949: dispersed knowledge, calculation, and acting man as real constraints on command; occupant-operators have local knowledge too, which is Hayek pointed at the plant. Praxeology as apodictic proof of residual-claimant primacy is refused. The file is Foundations of the Right. Nozick’s Chamberlain challenge: a patterned theory that must continually interfere has a problem; species-change at a threshold is the answer this stack offers, not a nightly tax. Agorism as withering (Konkin, Libertarian Left / left free markets). Public choice as a warning about offices. Exit as a mechanism (Hirschman; Tiebout as cousin).

Refused. Title through the scaled firm (limited liability 1855; Dodge 1919; Friedman 13 September 1970). Dropping the proviso. Bequest as innocent continuation of the mixer. NAP as a theory of the plant or as a substitute for domination. Shareholder primacy. Spencer as warrant. Joint-stock as end-state. Neoliberal statecraft (Thatcher, Reagan, Williamson 1989) as the stack — that is a pole’s mix, not a treatise. The 1955 trademark as the original sense of “libertarian.” Hoppe’s fork as the body. A finished constitution. Violent means.

The illicit step the right takes, named. From “I own me” to “I own the plant that commands you.” Cohen: self-ownership is not world-ownership. Macpherson’s reception (whether or not it is Locke): the person as proprietor of capacities, hired out. Limited liability makes the proprietor a non-person. That is the species error. The left’s illicit step is the mirror: from “dominion is the target” to “socialize the means of production under a dictatorship of the proletariat, and the office will retire.” Both steps are refused. That is the join.

7. Synthesis: agency, inheritance, fitness, polarity

The references this program has been using were never ornaments. They come together on this page.

Agency is ill-defined, and we still have to build. Paper 01: unread remainder before the act; agency at the time-instance; the compatibility map and the institutional ladder are two boards. CenLib maximizes institutional room for a unit that is not finished. A metaphysical libertarian can still build a shareholder oligarchy. A hard incompatibilist can still refuse one. The 1789 word is this paper’s; the 1955 word is not a substitute.

Inheritance is ill-defined twice. Biology: pangenesis, Weismann, Mendel, fitness as a later propensity (Mutual Aid). Title: Locke’s money clause, then bequest, then listed residual claim. Treating the second as the first — the plant went to the fittest blood — is a metaphor with a political use. The mixer is dead. The occupants are alive. Agency is predicated of the living unit.

Fitness was never repaired in the social sense. Spencerian “fit” is tautology-adjacent. Right-libertarian common sense still wears the costume. Left-libertarian common sense still wears Kropotkin. Neither legislates the triad. Nature does not write title.

Polarity does not pause for a domestic join. Game of Empires: the world oscillates — unipolar knockout, multipolar default, brief bipolar freeze — as empires vie over hegemonic supremacy at superpower scale. A title regime is also a pole’s mix (fiscal, money, standard, energy). Neoliberal practice was a pole spending that mix. Inner conflict is how a Lockean unit is lost into a ticker or a mass. Outer conflict is why isolated exit fails. Extra-hegemonic or simultaneous transition stays open problem 14. Energy abundance as post-scarcity cargo does not retire the board (Follow the Oil).

The point of the references, together: the unit is ill-defined; the warrants were borrowed while ill-defined; the word was captured twice; the remaining fight is property at scale; this stack is a proposed join, unfinished on purpose.

8. Post-scarcity, Harari, and why the warning is this paper’s

Yuval Noah Harari is a historian (Hebrew University of Jerusalem) who wrote two books of synthesis that then turn toward the future: Sapiens (Hebrew 2011; English 2014) and Homo Deus (2015/2016). No one has a crystal ball. His academic career gave him the time to put those books together. They have interesting things to say, and they validate a good deal of what this program is getting at — without being a source of CenLib axioms, and without being treated as prophecy.

*The claim of Sapiens. Homo sapiens cooperates in large numbers because of imagined orders*: money, nations, law, human rights, gods, corporations. Empires, in that book, are historically among the most successful political systems for knitting strangers into one order. That is a historian’s claim about cooperation technology. It sits beside this program’s Game of Empires without replacing it: horizon-kingship is an imagined order that becomes a garrison, a tax, a standard. Staying in that game is staying inside an order that treats persons as inputs to a pole.

*The replacement paradigm of Homo Deus.* As famine, plague, and war recede as the organizing terrors, humanism’s success undermines itself. Intelligence uncouples from consciousness. Algorithms begin to know a person better than they know themselves. A “useless class” can appear — not the exploited proletariat whose labor the 20th-century left assumed was economically crucial, but people who are no longer needed as workers or as soldiers. Authority migrates from humans to data. Harari’s own sentence, which this paper will not steal as a slogan: scholars should strive to develop new socio-economic models; the old ones no longer hold.

That last clause is the validation. This program is an attempt at those models: a unit (Agency), a board (Empires), a property split, a method that does not seize the office. Harari does not write the triad. He writes the pressure: if the masses lose economic value they may struggle against irrelevance rather than exploitation. Open problem 20 (automation without hiring) is that pressure inside CenLib. Shareholder primacy plus replacement tech is a reason not to hire, and so a reason not to trigger species-change. Staying in Game of Empires while rolling that tech out is the warning that belongs to the whole site: the pole will use the replacement; the person as unit is what would be replaced.

Date him. He is a historian predicting, not a seer. The books are 2014 and 2016. The board has moved. The pressure has not receded.

9. How this attaches to the other papers

Right-libertarian shareholder primacy treats the workforce as an input ensemble. Party-state planning treats the population as an administrative ensemble. Representative filters treat the demos as a mass to be sampled by careers. Replacement tech treats the person as an obsolete algorithm. All four are species errors relative to Paper 01.

If agency is an individual system that can prospect and then be the source of some of its transitions:

• personal / consumptive title is the legal completion of that system;
• productive commons at scale is the completion of many such systems in one plant;
• direct voice is the political completion;
• a method that does not seize the office is the consistency of ends and means.

Foundations of the Right is why the right’s unit-claim is real, and why it was spent on a non-person. Self-ownership is taken as agency; world-ownership through the firm is refused. Chamberlain is a pressure test, not a house. Hayek is a constraint, not a title regime.

Fractures is why the left’s goal-claim is real, and why the office did not retire. Date both captures of “libertarian” before arguing with either church.

Competition and Mutual Aid adds: do not underwrite this with Spencerian fitness or with Kropotkin as a proof. The triad is a legal design under an unfinished definition of the unit, not a finding of evolutionary biology. Bequest is not Mendel.

Equilibria adds the solution-concept choice and the CPR literature. Hardin is the right’s commons cartoon; Ostrom is the field. Game of Empires adds the board on which a pole can refuse Ostrom’s seventh principle — and on which the replacement tech is being rolled out. Inner conflict on that board (Dalio’s pair, taken) is why mixed constitution is unfinished (Polybius; open problem 15) and why the office did not retire. Outer conflict is why isolated exit fails (open problem 14): SWIFT, frozen reserves, entity lists, a rare-earth unplug, a strait closed (Follow the Oil). Extra-hegemonic or simultaneous transition — specify it or drop it. Energy abundance as post-scarcity cargo does not retire the board. It changes the unit the board will fight over next.

Who counts as an agent remains open: organism-agency in the Nobles is adjacent; machine agency is not a present franchise rule. The program does not, here, settle it.

Synthesis is how this hypothesis locks with Game of Empires: outer constraint, inner capture, shared unit. It does not restage the right-hand file or this polity file.

10. What this paper does not fake

No finished threshold rule. No finished investment instrument. No finished agenda jury. No finished pay system that cannot be vote-buying. No claim that stepping off is sufficient against polarity. No stock-market explainer that walks the no-equity-markets rule back into a “stakeholder index.” No claim that switching from Nash to PCE ends an arms race. No claim that Harari has proven a useless class. No claim that post-scarcity has arrived. No claim that CenLib is the US party, or that it is just Proudhon. No violent means.

The honest status is: a research program with a proposed stack, a named join of two libertarianisms at property, a named hybrid method, and a list of specs that are not yet specs.
