Claim
Left and right libertarianism both claim the person as unit and split on property. Locke’s logic is standing law, labour-mixing, a proviso, and a money clause that licenses inequality — not Rothbard, and not the US party. Capitalism as theory (Smith, marginalism, Mises, Hayek) and as practice (chartered companies, limited liability, Dodge v. Ford, Friedman 1970, a pole’s neoliberal mix) can be reconstructed without a church. Dean Russell, May 1955, trade-marked “libertarian” for classical liberals who had lost “liberal”; the Libertarian Party (1971) and Nozick (1974) filled it. Self-ownership does not entail world-ownership. Bequest is not fitness. Center libertarianism is named for the attempt to rejoin the two files at a species-change: keep the Lockean person; refuse title through the scaled firm.

Locke, the word, the firm
Fractures is the left. This board is the right: Lockean logic, capitalism as theory and as practice, the American inversion of “libertarian,” the figures, the economic ideas, and the joint — property — at which Center libertarianism tries to rejoin the two. Not a church. Not the US party restated. The right-anarchist span — Molinari, Spooner, Rothbard at the horn — has its own group. Warren, Tucker, and agorism sit with **left free markets** on the map.
1689 · Lockean logic
Two Treatises: standing law, not ‘do as one lists’
Second Treatise §22: freedom under a standing rule versus Filmer’s arbitrary will. §123: lives, liberties, and estates under the general name property. Government is instituted to preserve that. The person is the unit. This is the load-bearing Lockean sentence for CenLib — and the sentence later title-through-the-firm walks past.
The revolutionary left of the nineteenth century and the American right that later took the word libertarian are not two churches of liberty. They are two reconstructions of property, both claiming the person as unit, both dating a word they did not invent. Fractures reconstructed the left: shared 19th-century goal, method split as the theories grew, words captured after 1917. This paper is the other file: Lockean logic as the foundation of modern title; capitalism as a full economic theory and as a practice older than the theory; the figures of the right; the economic ideas they distilled; and the American inversion of “libertarian” (Dean Russell, FEE, May 1955; Libertarian Party, 11 December 1971; Nozick 1974).
The conflict is over property. That is the proposition this program has been using. It is not a slogan. Self-ownership does not entail world-ownership (Cohen 1995). Labour-mixing does not entail a joint-stock person that commands hired time. Bequest is not fitness, and not Mendel. Center libertarianism is named center because it is an attempt to reconcile left and right libertarianism on historically accurate terms: keep the Lockean person as unit of title and voice; refuse title through the scaled firm; change species at hired-labor scale rather than abolish personal property. It is not a Nolan-chart midpoint. It is a join at a named joint.
This is a scientific reconstruction, not a manifesto and not a brief for the US party. It articulates a problem (the right preserves Locke’s unit through a non-person), offers a model of how that happened (proviso dropped, money clause spent, limited liability, shareholder primacy), and leaves the remaining joints visible. It does not advocate violent means. It does not treat Hayek as Rothbard, Friedman as Nozick, or Smith as Spencer. Robbins (1932) defined economics on scarce means with alternative uses; that is a frame for a moment of allocation, not a proof that the orchard is impossible or that the fittest should take both apples. Competition & Mutual Aid dates the costume. This paper dates the legal furniture.
Read Agency so 1789 is dated. Read Fractures so 1857 is dated. Read Competition & Mutual Aid so the biological costume is not smuggled in as proof. Read Equilibria so Hardin’s pasture is not the only commons model. Read Game of Empires so neoliberal practice is a pole’s mix, not a treatise. Then Center for the stack. Then the map so the two anarchist traditions sit at the tips Faye never drew, and CenLib is the missing bend, not a Nolan midpoint.

Russell’s sentence, May 1955, The Freeman: “Let those of us who love liberty trade-mark and reserve for our own use the good and honorable word ‘libertarian.’” Webster still listed the free-will sense first. Russell cites that, then fills the word with private property and a small state. That is a documented capture, the mirror of the red-scare capture of “communist.” Both captures exist. Papers that do not date them argue with ghosts.
Hayek refused the new label as ugly and kept “liberal,” or “Old Whig” (“Why I Am Not a Conservative,” 1960, postscript to The Constitution of Liberty). Friedman, in the introduction to Capitalism and Freedom (1962), still calls himself a liberal in the European sense. Rothbard embraced the word and built anarcho-capitalism under it. Nozick is academic philosophy, not the movement’s organizer. The Libertarian Party (David Nolan and others, Colorado Springs, 11 December 1971) is a party. Do not flatten these. The growing body of thought is older than the trademark: Bastiat 1850, Spooner 1867, Mises 1920, Nock 1935, the three women of 1943 (Paterson, Lane, Rand), FEE 1946, Mont Pelerin 1947. Russell named a stream that was already running.
Fractures §7 is the left-hand vernacular. This section is the right-hand vernacular. Center libertarianism sounds like a rebrand of the US party only if 1955 is allowed to erase 1789 and 1857. It is not a rebrand. The name is the attempt to hold both dated senses at a property split neither side kept.
2. Lockean logic — the foundation, not the LP
Locke is not Rothbard. Date the text.
Two Treatises of Government, published 1689 (written earlier; the Glorious Revolution of 1688 is the political weather they are read in). The Essay Concerning Human Understanding, II.xxi: the question is badly posed as “whether the will be free.” The agent is free; the will is a power. That sentence is Paper 01’s. Later political economy that treats the firm or the party as the agent has already left Locke’s unit.
Standing law. Second Treatise §22: freedom is not Filmer’s “liberty for every one to do what he lists.” It is a standing rule, common to every one of that society, “a liberty to follow my own will in all things, where the rule prescribes not; and not to be subject to the inconstant, uncertain, unknown, arbitrary will of another man.” Pettit’s non-domination is a later name for this test. A kindly master is still a master. A listed residual claimant who happens not to fire you this quarter still holds a legislature.
Property in the person, then in the mixed. §27: “every man has a property in his own person”; the labour of his body is his; mixing that labour with what nature left unowned makes it his — “at least where there is enough, and as good, left in common for others.” That last clause is the Lockean proviso. §31: spoilage bounds appropriation; what perishes unused is more than his share. §33: appropriation of a parcel, by improving it, is no prejudice if enough and as good remains.
Money as the clause that licenses inequality. §36–37: gold and silver do not spoil. By consenting to money, men consent to “a disproportionate and unequal possession of the earth.” Labour-mixing, bounded by spoilage, becomes dynasty through a non-perishing token. Bequest then carries the pile past the mixer. This is Locke’s own opening. Right-libertarian reconstruction often spends the mixing and forgets the proviso, or keeps a weakened proviso (Nozick) and treats bequest as ordinary transfer. Rothbard drops the proviso as “a source of trouble.”
Government for property. §123: lives, liberties, and estates, “which I call by the general name, property.” Civil government is the remedy for the inconveniences of the state of nature in defending that. This is not “do as one lists.” It is not a night-watchman slogan until the night-watchman literature writes it (Nozick’s minarchism is 1974; the phrase is older). It is a theory of title, consent, and standing law.
What this program will not wash out. Locke’s involvement with the Carolina constitutions and with colonial title is part of the historical Locke, not an ornament. Macpherson, The Political Theory of Possessive Individualism (1962), reads him as the proprietor of capacities owing nothing to society. Tully (A Discourse on Property, 1980) and Waldron (The Right to Private Property, 1988) contest that reading. The reception is load-bearing either way: later right-libertarian common sense treats capacities as alienable title, including when they are hired. Date the reception. Do not pretend 1689 closed 1970.
The load-bearing residue for CenLib. The person is the unit. Liberty is standing law versus arbitrary will. Mixing labour is a starting picture of personal title. The proviso and the money clause are joints Locke opened and the later right did not keep in the same sentence as the mixing. Center restores the proviso at hired-labor scale: when a plant’s title is a legislature over other people’s time, enough-and-as-good is already gone.
3. Capitalism as economic theory
Theory arrives to explain a form that already extracts. Do not start in 1776 as if the East India Company (1600) and the Bank of England (1694) were waiting for Smith.
Mercantilism as the foil, physiocrats as the first “laissez-faire”
The early modern state treats bullion, charters, and colonies as the wealth of the prince. Vincent de Gournay’s circle is the usual attribution for laissez-faire, laissez-passer; Quesnay’s Tableau (1758) and Turgot (Réflexions, 1766) turn the question: wealth is a circulation of product, not a hoard. Cantillon’s Essai (published 1755, written earlier) names the entrepreneur as the bearer of uncertainty between known costs and unknown selling prices — the joint Knight and Mises later sit on. This is the first full theory of a “natural” economic order. It is not yet industrial capitalism. Turgot as minister (1774–76) already shows a pole spending a free-trade idea and then firing the minister. The slogan is older than the American trademark. This paper is the file.
Smith, 1759 and 1776
The Theory of Moral Sentiments opens with sympathy. The Wealth of Nations theorizes division of labour (the pin factory), markets, the limited use of an “invisible hand,” and the critique of mercantile monopoly. Darwin will later praise Smith’s sympathy in The Descent of Man (1871). That is moral psychology, not a gladiatorial warrant. Smith is not Spencer. Paper 04 exists so this paper does not have to say it twice. Competitive political economy is 1776. The biological costume is 1864.
Smith also writes the joint-stock company with suspicion (Book V): directors of other people’s money cannot be expected to watch it with the same anxious vigilance as their own. Limited liability will later make that the normal form. Smith did not write Dodge v. Ford.
Classical political economy as a science of a mode
Ricardo, Principles (1817): comparative advantage, rent, a labour theory of value the later left will invert. Say’s law as a claim about outlets. Mill, Principles (1848) and On Liberty (1859): harm principle, a stationary state, experiments in cooperative production. Mill is a bridge. He is not a US libertarian, and he is not Marx. Bastiat, The Law (1850): legal plunder; What Is Seen and What Is Not Seen: opportunity cost as a public argument. Cobden and Bright: Corn Law repeal, 1846, as practice of free trade. Constant, “The Liberty of the Ancients Compared with that of the Moderns” (1819): modern liberty is civil, commercial, representative; ancient liberty is the square. CenLib’s assemblies are an attempt not to let Constant’s moderns eat the square, and not to let the square eat civil title. That is later. Date him here so “liberty” is not one thing.
Marginalism, 1871–74
Jevons, Menger, Walras, independently. Value at the margin, subjective, not embodied labour. Date it so Capital I (1867) is not made to answer a theory that did not yet exist. Austrian capital theory and time-preference grow from Menger and Böhm-Bawerk. Marshall, Principles (1890), is the Anglophone neoclassical synthesis. The later right will take the Austrian fork more than Marshall’s.
Calculation and knowledge
Mises, “Die Wirtschaftsrechnung im sozialistischen Gemeinwesen” (1920): without private title in the means of production there are no genuine prices, so a socialist commonwealth cannot calculate which uses are worth the scarce means. Die Gemeinwirtschaft (Socialism, 1922) is the book-length case. Hayek, “The Use of Knowledge in Society,” American Economic Review 35 (1945): the data are dispersed in persons; the price system is a telecommunications of tacit knowledge. Both are real constraints. Paper 01 already takes Hayek’s observation as an agency argument against command. The title-regime conclusion is not this program’s. Occupant-operators have local knowledge too. Pointing Hayek at the plant is allowed.
Human Action: acting man as science
Human Action (1949; German Nationalökonomie, 1940) is the load-bearing book. Praxeology: human action as purposeful behavior; catallactics as the market part. Mises is not a natural-rights theorist. He is a utilitarian of social cooperation who tried to make action a science. Rothbard will later put natural rights under Austrian economics. Do not flatten these. Acting man is the economist’s cousin of Agency’s organism-scale unit. This program takes the unit, calculation, and subjective value. It refuses praxeology as apodictic proof that the residual claimant must be a private legislature. Mises constrains Gosplan. He does not write Dodge v. Ford. The file is this paper, not a 1920 footnote.
Public choice, Coase, Hardin
Knight, Risk, Uncertainty and Profit (1921): profit as the return to bearing unmeasurable uncertainty. Coase, “The Problem of Social Cost” (1960): if transaction costs are low, assign rights and let bargaining work; the assignment still matters when costs are not low. Buchanan and Tullock, The Calculus of Consent (1962): government failure as a symmetric object of study. Schumpeter, Capitalism, Socialism and Democracy (1942): creative destruction. Hardin, “The Tragedy of the Commons” (1968): open access as a PD only private title or the state can solve — a parable Equilibria has already marked as not Ostrom.
These are the load-bearing economic ideas of the later right. They are not one axiom. Calculation and knowledge constrain command. Public choice constrains romance about offices. Coase constrains romance about “the” assignment of rights. Hardin is the commons cartoon the right prefers. Ostrom is the field literature. CenLib takes the constraints and refuses the cartoon.
4. How it was put into practice
Theory did not invent the form. The form invented a theory, then the theory rewrote the form.
Chartered companies and the fiscal-military state. East India Company, 1600. Bank of England, 1694: a joint-stock machine for a state at war. South Sea Bubble, 1720; Bubble Act the same year; repeal 1825. Glorious Revolution 1688 as the political settlement of standing law plus a capital market for public debt. Locke is read in that weather. Capitalism as practice is a named mix of hegemonies: fiscal extraction, money, routes, force. It is not a seminar.
Enclosure. English parliamentary enclosure, eighteenth and early nineteenth centuries, converts common right into several title. The proviso’s “enough and as good” is the sentence this practice spends. E. P. Thompson is the social history; this paper needs only the legal fact: a commons with users became a title with residual claimants.
Limited liability. UK Limited Liability Act 1855; Companies Act 1862. The joint-stock company with capped loss is the invention that lets absentee title scale without the owner dying of the firm’s debts. The firm becomes a person in law. Persons inside it become inputs. This is the species error Paper 01 names, in statutory form.
US founding. Madison, Federalist 10: property as the most durable source of faction; a large republic as a filter. More democratic than monarchy; still an aristocracy of representation and an electoral college. “We have never implemented a true democratic government” is Center’s claim; this paper adds: the founding is already a property settlement, not a Locke seminar.
Gold, then its unmaking. Nineteenth-century gold standard as the money hegemony of Britain’s moment; 1931 and 1971 as the unmaking. Follow the Oil and the petrodollar paper in Empires are the successor instrument. Right-libertarian “sound money” is often a gold nostalgia that does not date 1974–75 as invoicing plus recycling.
Shareholder primacy as doctrine. Berle and Means, The Modern Corporation and Private Property (1932): ownership split from control. Dodge v. Ford Motor Co., 204 Mich. 459 (1919): the residual claimant’s primacy named in a holding. Friedman, “The Social Responsibility of Business Is to Increase Its Profits,” New York Times Magazine, 13 September 1970: the popularization. Delaware law as the later venue. Listed stocks and bonds make the legislature liquid. This program’s negative rule is an agency rule before it is a finance rule.
Neoliberal practice is a pole’s mix, not a treatise. Mont Pelerin Society, 1947 (Hayek, Robbins, Friedman, Röpke, and others): academy-to-ministry pipe. IEA (London, 1955). Thatcher 1979, Reagan 1981: disinflation, privatization, capital mobility, a fight with unions. Williamson, “What Washington Means by Policy Reform” (1989): a list, not NAP. This is Game of Empires cargo — money, standard, fiscal, alliance. Date it as statecraft. Do not collapse it into Nozick’s Wilt Chamberlain, and do not collapse CenLib into it. A pole can spend Hayek without taking Locke’s unit, and can spend Friedman without taking Belsham.

Locke (1632–1704)

Smith (1723–1790)

Cantillon, Quesnay, Turgot
Already §3. What CenLib takes. Bastiat, Cobden, Constant
French and English liberals of the mid-nineteenth century. Legal plunder; Corn Laws; liberty of the moderns. What CenLib takes. The critique of the state as a machine for living off others — a critique that also applies to a private legislature. Constant’s distinction, so assemblies are not nostalgia. What it refuses. Treating 1846 free trade as a finished property axiom.
Mill (1806–1873)
Harm principle; cooperative experiments; a stationary state. What CenLib takes. The harm principle as a cousin of standing law; the admission that production can be reorganized without abolishing the person. What it refuses. Mill as a US-libertarian ancestor, and Mill as a substitute for Ostrom.
Warren (1798–1874)
First American anarchist. Cincinnati Time Store, 1827; The Peaceful Revolutionist, 1833; Equitable Commerce, 1846. “Cost the limit of price”: labour-time, not market-what-it-will-bear, bounds just exchange; profit as “civilized cannibalism.” Individualist and anti-usury. The forgotten starting point of the right-anarchist slice — inner, toward Center, not Rothbard’s outer horn. What CenLib takes. Experiments in occupancy and labour-notes as cousins of possession. What it refuses. Labour-time as a finished price theory (marginalism already sits on this paper); Warren as a brief for joint-stock.
Molinari (1819–1912)
“De la production de la sécurité,” Journal des Économistes, February 1849; then Les Soirées de la rue Saint-Lazare the same year. First systematic case that police and defense can be produced on a market. French liberal school (Say, Bastiat), not the American individualists. He said liberté de gouvernement / political competition, not “anarcho-capitalism.” Rothbard later named the reception. The European economic tip of this slice. What CenLib takes. The question — must security be a monopoly office? — as a real question. What it refuses. Private production of security as a finished title regime over the plant.
Spooner (1808–1887)
No Treason (1867): the Constitution binds no one who did not sign; natural-law individualist; also an abolitionist. Private mail as a practice. The right claims him for anti-statism. Occupancy sits closer to Proudhon than to homesteading of a plant that hires hundreds. What CenLib takes. Suspicion of a document nobody signed. What it refuses. Spooner as a brief for joint-stock anarchy.
Herbert (1838–1906)
Voluntaryism: voluntary taxation, Spencerian, refused the anarchist label. Sits between classical liberal and the anarchist shoe. Date him so 1955 does not invent the body.
Tucker (1854–1939)
Liberty (1881–1908). Occupancy-and-use against absentee landlordism; later toward Stirner. He called the position anarchistic socialism and “unterrified Jeffersonianism.” The four monopolies (money, land, tariffs, patents) are the target: free markets to destroy capitalist privilege, not to baptize the scaled firm. “Interest is theft, Rent Robbery, and Profit Only Another Name for Plunder.” The left claims the possession rule. The later right claims the anti-statism and drops the monopolies. Rothbard, “The Spooner-Tucker Doctrine: An Economist’s View” (1965), is that capture dated — the cousin of Russell 1955. Spencer (1820–1903)
Social Statics (1851) predates Origin (1859). “Survival of the fittest,” Principles of Biology (1864). The costume. What CenLib takes. Nothing as a warrant. What it refuses. The whole social-Darwinian experiment as a proof of a title regime. Paper 04 is the argument.
Menger, Böhm-Bawerk, Mises
Austrian line, split so Mises is not a footnote to 1920. Menger 1871: subjective value at the margin. Böhm-Bawerk: capital as time. Mises: calculation (1920); Socialism (1922); Human Action (1949) — acting man as the primitive of catallactics, a utilitarian of social cooperation, not a natural-rights theorist. Rothbard will overlay natural rights. What CenLib takes. The acting person as the economic cousin of Agency’s unit; calculation and subjective value as constraints on command. Dispersed knowledge as an agency argument; spontaneous order as a warning against Gosplan. What it refuses. The step from “no one designed the price of bread” to “no one may redesign the title of the plant.” Ostrom’s users design rules. That is also order that grew, at a different grain. Nock, Chodorov, the Old Right
Nock, Our Enemy, the State (1935): the state as a different species from government; a Jeffersonian-individualist polemic. Chodorov and the early Freeman. Friedman (1912–2006)

Public choice and transaction-cost economics. What CenLib takes. Public choice as a proof that the residual claimant is innocent. A private legislature is also a failure mode.
Rothbard (1926–1995)
Man, Economy, and State (1962); For a New Liberty (1973); Ethics of Liberty (1982). Self-ownership, homesteading without the proviso, NAP, anarcho-capitalism, joint-stock as the end-state. The most complete named right-anarchist reconstruction, and the outer horn of the slice — not the whole slice. Molinari, Spooner, and David Friedman sit on this span. Warren and Tucker sit with left free markets on the map; Rothbard claimed their names in 1965 and dropped the four monopolies. What CenLib takes. The person as unit, stated as self-ownership; consistency of ends and means (which Konkin radicalized as left-market method). What it refuses. Dropping the proviso; the scaled firm as homestead; bequest as innocent transfer; NAP as a theory of the plant; joint-stock as the end-state; the 1965 capture of Spooner–Tucker as identity. Agorism is not stolen from this tent. Konkin named the Libertarian Left.
The Tannehills and David Friedman
Morris and Linda Tannehill, The Market for Liberty (1970). David Friedman, The Machinery of Freedom (1973): consequentialist anarcho-capitalism, not Rothbard’s natural rights. A different house on the same horn. Do not flatten these with Milton Friedman, and do not flatten them with Nozick. What CenLib takes. The fact of the houses — the right-anarchist tent is not one book. What it refuses. Either house as the stack.
Nozick (1938–2002)
Anarchy, State, and Utopia (1974). Side-constraints; entitlement (acquisition, transfer, rectification); Wilt Chamberlain; a minimal state via an invisible-hand reconstruction from a Lockean state of nature; a weakened proviso. Academic, not organizational. What CenLib takes. The Chamberlain challenge as a pressure test: a patterned theory that must continually interfere has a problem. The triad answers as species-change at a threshold, not as a nightly redistribution of just holdings. What it refuses. The premise that the arena’s title, and the plant’s title, were already just when they command hired labour. Minarchism as the stack.
Konkin (1947–2004) — not this tent
New Libertarian Manifesto (1980). Movement of the Libertarian Left. Agorism is left free markets, not a fork inside the right-anarchist tent. Capital-statism — the class that takes a net gain from the State’s intervention — is the enemy; the entrepreneur is not the pro-statist capitalist. Worker/boss is a feudal holdover; the corporate hierarchy imitates the State. He sat historically next to Rothbard, then named the Left. On the map he sits clockwise of CenLib, with Tucker and Proudhon, not with Rothbard’s horn. What CenLib takes as withering. Counter-economy until the absentee form is unused — taken from the left-market file. What it refuses. Black markets as such; LP property identity; Konkin as Rothbard.
Hoppe, and the later forks
Argumentation ethics; Democracy: The God That Failed (2001); covenant communities; a paleolibertarian turn. Date it as a fork. On the map this is a walk up from the anarchist horn toward the office. A covenant that becomes blood-and-soil has left the shoe. Bleeding-heart and neo-classical liberal replies (Zwolinski; Tomasi, Free Market Fairness, 2012) are another fork: they try to join Hayek to Rawls. What CenLib takes. The fact of the forks — the right is not one church, any more than the left is. What it refuses. Hoppe as the body of thought; Tomasi as this program’s join (his join is still title-through-the-firm plus a safety net). CenLib’s join is a species-change at scale.
Carson, C4SS — the inner edge after the capture
Kevin Carson, Studies in Mutualist Political Economy (2007); Chartier, Long, the Center for a Stateless Society. Tucker’s four monopolies recovered under subjective value. Left-wing market anarchism — sits with agorism, not with Rothbard’s horn. What CenLib takes. Occupancy and privilege-as-the-target. What it refuses. Treating C4SS as this stack’s constitution.
The right-anarchist slice is a span. Outer horn: Molinari’s security market, Rothbard’s named school, David Friedman. Hoppe walks up. Warren, Tucker, Carson, and agorism are not this span — occupancy and the four monopolies sit with left free markets on the map; Konkin named the Libertarian Left. “National-anarchism” is a captured word and sits with Faye’s right horn on the map, not here as a tip.
6. The economic ideas, as a list that can be attacked
Do not leave the right as biographies. These are the ideas, compressed.
- Self-ownership. The person is not an organ. Taken as agency. Not taken as world-ownership.
- Homesteading / first appropriation. Mixing or first use yields title. The proviso is the fight. Rothbard drops it; Nozick weakens it; CenLib restores it at hired-labor scale.
- Justice in transfer, including bequest. Nozick. How mixing becomes dynasty. Bequest is a legal operation, not fitness.
- Rectification. Nozick’s third topic, under-specified in the book and in the movement. Named so it cannot be forgotten: a title regime that cannot say how stolen title is unwound is not finished.
- Non-aggression principle. Forbids initiating force. Does not theorize domination without a punch (Pettit). Does not theorize the plant.
- Subjective value / marginalism. Needed for calculation. Not a property axiom.
- Spontaneous order / catallaxy. Discovery procedure. Illicit step: from undesigned prices to undesigned title of the plant.
- Calculation problem (Mises 1920) and acting man (1949). Real constraint on command. Occupant-operators still need a price-like signal. Open problem 9 is partly this: capital without dominion still has to calculate. Human Action is the organistic cousin of Paper 01. Praxeology as apodictic close is refused.
- Knowledge problem (Hayek 1945). Real constraint. Local knowledge sits with users (Ostrom 4) as much as with residual claimants.
- Sound money / Austrian business cycle. Time-preference, malinvestment, gold nostalgia. Date 1974–75 petrodollar as the actual successor instrument, not a seminar.
- Night-watchman versus anarcho-capitalism. Minarchism (Nozick, Friedman in practice) versus Rothbard. A split inside the right, analogous to 1872 on the left: goal (person as unit, markets) closer than method (keep a thin state / abolish it). The anarchist side of that split is itself a span: inner individualists (Warren, Tucker) versus outer horn (Molinari, Rothbard, David Friedman). Agorism is the left-market file, not this split. The map is the placement.
- Negative versus positive rights. Berlin 1958 as the English; the right takes negative. Pettit: non-domination is not “hands off.” CenLib takes standing law and non-domination, not “as long as they don’t punch you.”
- Shareholder primacy / residual claimancy. The scaled firm as person. The species error.
- Public choice / government failure. Real. Not a proof that private legislatures are innocent.
- Coase: assign rights, bargain. Real when costs are low. The assignment is the political question. Hardin’s pasture is the cartoon; Ostrom is the field.
- Comparative advantage / free trade. Ricardo. A pole will still tariff (2018 Section 301). Ideas are not the board.
- Creative destruction. Schumpeter. Churn is real. Replacement tech under shareholder primacy is open problem 20, not a hymn.
- Time preference / capital structure. Austrian. Not a warrant for dynasty.
- Tiebout sorting. Vote with your feet. Exit as Hirschman. CenLib uses exit (agorism) and voice (assemblies). Exit without voice is the kindly city-manager.
- NAP-as-sufficient. The movement’s compression. Insufficient against domination, against the plant, against a pole.
7. The property conflict — the joint this program is for
Left libertarianism (1857 sense, and the 19th-century anarchist/Marxist diagnosis): a class monopolizes command over labour-time through title and/or the office. The target is dominion, not having a coat. Proudhon: possession versus property. Marx after 1848: abolish bourgeois property in the means of production, not property generally. The applied test seized an office that did not retire.
Right libertarianism (1955–74 sense, built on Lockean furniture): the person owns herself; mixing or first use yields title; transfer including bequest is just if the acquisition was; a thin state or no state. The target is the office, not the scaled firm. The scaled firm is treated as a person (limited liability, residual claimancy). Hired labour is treated as a voluntary transfer of a service, not as a legislature over time.
Both claim the person as unit. They split on what the unit may own when other persons’ time is the cargo.
Cohen (1995): self-ownership does not entail world-ownership. Joint ownership of the external world can sit with self-ownership; unlimited first-appropriation plus bequest is a further claim. That is the analytic joint. CenLib does not take Cohen’s further egalitarianism as a constitution. It takes the split: keep self-ownership as an agency claim; refuse the leap to world-ownership through the scaled firm.
Macpherson (1962): possessive individualism — the person as proprietor of capacities. Whether or not that is Locke, it is the reception. Hiring capacities out to a residual claimant is how the proprietor becomes a private legislature.
Locke’s own joints, restated:
- The proviso: enough and as good. At hired-labor scale the unowned common is gone.
- Spoilage: bounded by use. Money cancels the bound.
- Money: tacit consent to unequal possession. Dynasty sits here.
- Bequest: not in §27. It is a later legal operation treated by Nozick as transfer.
CenLib’s third option. Consumptive and personal title stay with the person (the right’s unit, kept; Proudhon’s possession, kept). Productive title: solo, ordinary private title; when demand requires hired labor, legal species changes (the left’s diagnosis of dominion, kept; Bakunin’s firm from below, kept as structure). No listed stocks or bonds (absentee sovereignty, refused). Agorist withering (method from Konkin’s left free-market file). Not a patterned redistribution of just holdings (Nozick’s challenge, answered as species-change, not as a nightly tax). Not a party-state (the applied left’s failure, refused).
That is why it is called center. Not because it is moderate. Because it is the attempted reconciliation of two libertarianisms that both named liberty and then fought over property.
8. Agency, inheritance, fitness — the connected points
The references this program has been using come together here. They were never ornaments.
Agency ([Paper 01](/agency)). Belsham 1789: libertarian is a claim about the unit, not about markets. Locke Essay II.xxi: the agent is free. Institutional agency: how far a structure leaves persons as sources rather than ensembles. Right-libertarian shareholder primacy treats the workforce as an input ensemble. Applied Marxism treats the population as an administrative ensemble. Both are species errors relative to the unit. CenLib is a bid to maximize institutional room for a unit that is still ill-defined. It does not wait for van Inwagen. The unread remainder is prospected, not closed. A metaphysical libertarian can still build a shareholder oligarchy; a hard incompatibilist can still refuse one. The compatibility map and the property map are two boards.
Inheritance, ill-defined twice. Biology: Darwin’s pangenesis (1868), Weismann’s cut, Mendel rediscovered 1900, fitness as a propensity later. Social “fit” was never repaired (Mutual Aid). Title: bequest, dead-hand, dynasty through the money clause. Treating the second as the first — “the plant went to the fittest blood” — is a metaphor with a political use. Ill-defined biological inheritance does not underwrite ill-defined title inheritance. The mixer is dead. The occupants are alive. Agency is predicated of the living unit, not of a will in a vault.
Fitness. Spencerian social fitness: wealth, power, market share as “fit.” Tautology-adjacent, never given a propensity reading. Right-libertarian common sense still wears this costume (Paper 04). Left-libertarian common sense still wears Kropotkin. Neither is a proof of a property law. Nature does not legislate the triad. The triad is a legal design under an unfinished definition of the unit.
Polarity ([Empires](/empires)). A title regime is also a pole’s mix: fiscal, money, standard, alliance, energy. Neoliberal practice was a pole spending that mix. Limited liability and the dollar rails are instruments. Inner conflict (Dalio’s pair, taken) is how a mix is lost without a knockout — including how a Lockean unit is lost into a ticker or a mass. Outer conflict is why isolated exit fails. Extra-hegemonic or simultaneous transition stays an open problem. Energy abundance as post-scarcity cargo does not retire the board (Follow the Oil).
Equilibria. Hardin is the right’s commons cartoon. Ostrom is the field literature CenLib is allowed to lean on. Public choice is the right’s warning about offices; Olson is the free-rider problem of assemblies and of agorist contribution. NAP-as-sufficient is a refusal to theorize domination and latent groups. PCE shows (C,C) can be an equilibrium without being a best response. It does not write the triad.
The point of using these references together is not a collage. It is one claim: the unit is ill-defined; the warrants were borrowed while ill-defined; the word was captured twice; the remaining fight is property at scale; CenLib is a proposed join, unfinished on purpose.
9. What CenLib takes from the right — and what it refuses
The widget on Center is the short board. This is the argument.
Taken. The person as unit (Locke; self-ownership as agency). Standing law versus arbitrary will (§22; Pettit as later name). Local knowledge as a constraint on command (Hayek; Mises on calculation). Chamberlain as a pressure test (species-change, not a nightly pattern). Public choice as a warning about offices. Exit as a mechanism (Hirschman; Tiebout as cousin). Agorism as withering is taken from Konkin’s left free-market file, not from this tent’s end-state.
Refused. Title through the scaled firm. Dropping the proviso. Bequest as innocent continuation of the mixer. NAP as a theory of the plant. Shareholder primacy. Spencer as warrant. Joint-stock as end-state. Neoliberal statecraft as the stack. The 1955 trademark as the original sense. Hoppe’s fork as the body. Violent means. A finished constitution.
The name. Center libertarianism rejoins the 1789 agency sense with a property split that neither US right-libertarianism nor applied Marxism kept. The right preserves Lockean title through the scaled firm and so reconstitutes oligarchy. The left could not address private property without abandoning it, or addressed it by an office that did not retire. The attempted reconciliation is the triad. That is why it is called center. Fractures had the left. This paper has the right. Center is the join, and it is not finished.
10. Attachment to the other axes
Agency is why the person cannot be replaced by ticker, class, or party. This paper is why the right’s unit-claim is real, and why it was spent on a non-person.
Fractures is the left-hand capture of the word and the method split. This paper is the right-hand capture and the property file. Read both before Center. Do not flatten left-internal splits into the left/right chasm; do not flatten Hayek, Friedman, Rothbard, and Nozick into one church.
Competition & Mutual Aid is why Smith is not Spencer, and why bequest is not fitness. This paper spends that warning on title.
Equilibria is why Hardin’s pasture is not Ostrom, and why public choice and Olson sit beside NAP rather than under it.
Game of Empires is why neoliberal practice is a pole’s mix, why rails and limited liability are instruments, and why stepping off is not leaving the board. Inner conflict: a Lockean unit lost into a ticker. Outer: a pole that can unplug a local commons (Ostrom 7).
Center is the stack. The map is where that stack sits among the systems: opposite mixed-economy center, between the two anarchist traditions, not between the two offices. The remaining specs — threshold, investment without dominion, allotted agenda, mixed constitution, simultaneity — stay open because that is where past attempts decomposed.
11. What this paper does not claim
It does not claim that Locke wrote Rothbard. It does not claim that Smith wrote Spencer. It does not claim that 1955 invented a body of thought that was already running. It does not claim that Mises proved shareholder primacy. It does not claim that Cohen wrote the triad. It does not claim that dropping listed stocks is a finished capital instrument. It does not treat neoliberalism as NAP, or CenLib as neoliberalism. It does not advocate violent means. It does not treat the US Libertarian Party as Belsham, or as Déjacque.
It does claim that the American word is a dated inversion; that Lockean logic has joints the later right did not keep; that capitalism as theory and as practice can be reconstructed without a church; that the fight with the left is over property at scale; and that CenLib is an attempt to join the two libertarianisms at that joint, unfinished on purpose.
12. Pressure tests
- “CenLib is the LP.” Only if 1955 erases 1789 and 1857, and if the triad is ignored. The LP end-state is title through the firm. This stack refuses that end-state and steals agorism as method.
- “CenLib is just Proudhon.” Proudhon did not have Hayek’s knowledge problem, Nozick’s Chamberlain challenge, or Cohen’s self/world split as named tools. The join uses the right’s tools against the right’s firm.
- “The proviso is enough.” It is not a finished threshold rule. Open problem 8. Restoring it at scale is a constraint, not a ministry.
- “Bequest can be kept if mixing was just.” The mixer is dead. Agency is of the living. Open problem 33.
- “Calculation requires residual claimants.” Calculation requires a signal. Occupant-operators can have one. The positive instrument is still missing (open problem 9). Mises constrains Gosplan. He does not write Dodge v. Ford.
- “NAP forbids the triad.” Species-change at a legal threshold is not a punch. If NAP forbids all redesign of title, it has already chosen world-ownership. That is the illicit step.
- “This is anti-capitalist tribe.” Capitalism as theory is reconstructed here with primary dates. Capitalism as practice is dated as limited liability, gold, Dodge, Friedman 1970, a pole’s mix. Critique of a species error is not a red scare.
